Conditions of Use

ARTICLE 1: The field of application of the terms of sale

The present general conditions of sale apply to all the sales concluded by means of the www.vinyland.com web site.

ARTICLE 2: The availability of records

The second-hand records are available only in one copy. So we cannot garantee the delivery of an item if the number of orders is superior to the number of items in store.

ARTICLE 3: Prices

Prices indicated in Euro are considered without shipping costs. They can be changed at any time without notice, knowing that all items will be charged on the current basis at the moment of the ordering process. The price is payable at once and in a single payment during the ordering process. All the orders are charged and payable in Euro only. For any delivery outside Metropolitan France, possible customs charges or local taxes stay chargeable to the addressee.

ARTICLE 4: Shipping fees

Shipping fees include a contribution to packaging costs (50 cents of euro by order) as well as the costs of shipping. It consists of a fixed fee and a fee according to the weight of the item(s). It is better for the customer to gather many items in one single order. I cannot group together two different orders, in that case shipping fees will be charged to you for each order.

ARTICLE 5: Payment method

All orders are payable in Euro. To pay his order, the customer has one mean of payment aimed within the order form: bank card (credit card, Mastercard, Visa).

The customer guarantees to Vinyland that he has all authorizations possibly necessary to use the method of payment which he will have chosen, during the ordering process.

Vinyland reserves the right to suspend or to cancel any order andor delivery, whatever their nature and level of execution, in case of nonpayment of any sum which would be due by the customer, or in case of incident of payment.

The delivery of any new order can be suspended in case of a delay in the payment of a previous order. Vinyland reserves the right to ask for a photocopy of the customer's ID card for any payment by bank card. Within the regulations against frauds on Internet, the informations concerning your order can be passed on in any third party for check.

Secured payment:
For your safety, a secured payment is provided to you.All the information concerning your bank card will be coded and protected by the SP Plus service from the french bank Caisse d'Epargne

Payment by check:
Only checks from a current account in a French bank (metropolitan and French Overseas Departments and Territories) will be accepted.

ARTICLE 6: Shipping

Either you're ordering from France, Europe or overseas, we deliver you by mail. The delivery time includes the time of validation of your payment, and the preparation of the parcel (24 hours maximum) as well as the time of routing. The average delivery time between the ordering and the receving of your parcel is about 3 or 4 days for France, 4 to 8 days for other countries, but it is not a deadline and vinyland.com is not responsible for possible shipping delays, specially in distant foreign countries.
If the country of delivery is not correctly mentioned into your profile, I might not send you all the records you ordered, in order to compensate for the missing shipping fees.

ARTICLE 7: Guarantee : satisfied, exchanged or refund

All records proposed on this site are second-hand records such as you would find in a second-hand record dealer's or at a garage sale. Meaning a second-hand record is an already used record, wich level of condition is described during the sale.

According to the article 1641 (and followings) from the Civil Code, the seller protects the buyer, in any case, from all the harmful consequences of the defects and the latent defects that would may reveal the sold goods, under reserve that these last ones are indicated to him from their appearance. In any case, the buyer will have to bring the evidence of the latent defect on the day of the delivery. The expenses of return will be paid off then entirely to the buyer and the exchange done at once.

You then have to return your goods within seven days following the reception of your parcel (in its packaging and with the corresponding invoice), notifying us the motive for return and indicating the reference of invoice to which he relates, at this adress :

ARTICLE 8: Right of revocation

Within the laws of online sale, the consumer (according to the Article L 121-20 of the French code of consumption) has got a seven (7) days period to apply his right of revocation without having to prove motives or to pay any penalties, with the exception of the expenses for returning the goods he has odered. The period above goes from the reception for the items ordered. When the period of seven days expires on a Saturday, a Sunday or a Bank holiday, it is extended until the next first working day.

ARTICLE 9: Transfer of property and transfer of risks

The transfer of property of products for the benefit of the buyer, will be completed only after full payment of the price by this last one, and though whatever the delivery date the aforementioned products is. On the other hand, the transfer of risks of loss and deterioration of the products will be completed after the delivery and reception of the aforementioned products by the Buyer.

Vinyland.com gets free of any responsibility in case of non-fulfillment of the contract due to a case of natural event (strike, flood, fire,...) or human fact event (terrorism action, transportation accident,...). All the clauses appearing in the present general conditions of sale, as well as all the operations of purchase and sale which are concerned, will be subjected to the French law, the Courts will be those in Besancon, from which Vinyland.com is related to, where the contract between the parties is established.

ARTICLE 13: Acceptance of the buyer

The present general conditions of sale as well as the price lists are expressly approved and accepted by the buyer, who declares and recognizes to have a perfect knowledge, and give up, therefore, to take advantage of any contradictory document and, notably, his own general conditions of purchase, the act of purchase leading to the acceptance of the present general conditions of sale.
